Title 38 › Part PART II— - GENERAL BENEFITS › Chapter CHAPTER 11— - COMPENSATION FOR SERVICE-CONNECTED DISABILITY OR DEATH › Subchapter SUBCHAPTER I— - GENERAL › § 1103
You cannot get VA disability or death benefits by saying an injury or illness was caused by your use of tobacco while you were in active military, naval, air, or space service. That rule does not stop service connection if the condition was otherwise shown to be caused or made worse by service, or if it became apparent to the required degree during any presumptive period listed in sections 1112 or 1116.
