If premiums weren’t waived only because the insured died before six months of total disability, and the beneficiary files proof the Secretary accepts with the Department within one year after the insured’s death, the policy is treated as in force at the date of death and any unpaid premiums become a lien on the insurance proceeds. If the beneficiary is mentally incapable or a minor, that proof may be filed within one year after the legal disability is removed.
