Pays a death benefit when someone who was entitled to basic educational help, or who would have been except for certain rules, dies from a service-related cause while on active duty or within one year after leaving active duty. The money goes to the first living person in this list: the person named as beneficiary on the individual’s Servicemembers’ Group Life Insurance, the surviving spouse, the surviving children (shared equally), or the surviving parent or parents (shared equally). If none of those people survive, no payment is made. The payment equals the total of amounts taken from the person’s basic or retired pay, amounts collected from the person, and any contributions the person made, minus any education benefits already paid to them and other accrued benefits paid or payable. The payment is treated as a benefit and as an earned entitlement under the education benefit rules.
