The President appoints an Under Secretary for Health, and the Senate must confirm that person. The Under Secretary must be chosen without regard to politics and only for proven ability in medicine, health-care management or finances, plus strong experience with the Veterans Health Administration or similar programs. The Under Secretary runs the Veterans Health Administration and reports to the Secretary. When the job is open or about to open, the Secretary must create a commission to recommend candidates. The commission includes three people for clinical care/medical research/education, two veterans who use the VHA, two people with management experience in veterans health or similar programs, the Deputy Secretary of Veterans Affairs, the Chairman of the Special Medical Advisory Group under section 7312, and, if the Secretary wants, one former Under Secretary for Health (including a former Chief Medical Director of the Veterans’ Administration). The commission must name at least three candidates, send them to the Secretary, who forwards them to the President with any comments. The President can ask for more names. The Assistant Secretary or Deputy Assistant Secretary who handles personnel and labor relations serves as the commission’s executive secretary.
