Last updated Apr 6, 2026|Official source

Summary

Gives eligible veterans education benefits based on how long they served on active duty after January 31, 1955. For every month (or part of a month) of that service, a veteran gets one and one-half months of full-time benefits (or the part‑time equivalent). If a veteran served 18 months or more and was released in a way that satisfied their active‑duty obligation, they get 45 months of benefits. For someone on active duty on December 31, 1976, or whose eligibility comes from section 3452(a)(1)(B), entitlement is measured to their first discharge or release after December 31, 1976. If a veteran’s benefit period ends in the middle of a quarter or semester, it is extended to the end of that quarter or semester. In schools not on quarters or semesters, if the benefit ends after most of a course is done, it is extended to the end of the course or for 12 weeks, whichever is shorter. Except for those timing extensions and rules in subchapter V, no veteran may get more than 45 months of benefits.

(b)Whenever the period of entitlement under this section of an eligible veteran who is enrolled in an educational institution regularly operated on the quarter or semester system ends during a quarter or semester, such period shall be extended to the termination of such unexpired quarter or semester. (c)Except as provided in subsection (b) and in subchapter V of this chapter, no eligible veteran shall receive educational assistance under this chapter in excess of 45 months.
