If a person has the right to be rehired by the federal government under section 4312, they must be placed back into a job that fits the rules in section 4313 unless one of the exceptions below applies. If the Director of the Office of Personnel Management (OPM) finds either that the old agency no longer exists and its work was not moved, or that it is impossible or unreasonable for that agency to rehire the person, OPM must find a job at another Federal executive agency that matches the person’s seniority, status, and pay, meets section 4313, and for which the person is qualified, and must make sure the person is offered that job. If the employer was in the judicial or legislative branch and says it cannot reasonably rehire the person, the person can apply to OPM and OPM must arrange a similar offer as described above. The same rule applies to a National Guard technician covered by section 709 of title 32 if the State adjutant general says rehire is impossible or unreasonable; the technician may apply to OPM for an alternative job offer.
