You can ask for a higher-level review of the decision made by the agency that decided your claim. The Secretary must approve every request. Your request must be in writing in the form the Secretary sets and must be made within one year of the agency’s decision. You may ask for a reviewer in the same office or in a different office, and the Secretary cannot deny a different-office request without good reason. The higher-level reviewer must re-check the decision from scratch but only using the evidence that was in the original file. The agency must send you (and your representative) a notice that says whether any evidence was not considered and what options you have to get that evidence reviewed.
