When the Secretary decides about a claimant’s benefits, the Secretary must give the claimant and their representative a prompt notice that explains how to ask for a review. The notice must say what issues were decided, sum up the evidence and the laws used, point out any findings that help the claimant, explain what elements were missing if the claim was denied, say how to get the evidence used, and, if needed, list the criteria to get service connection or a higher payment. The Secretary may send the notice electronically if the claimant or representative chooses and that choice can be revoked at any time in the way the Secretary sets. Each year the Secretary must ask stakeholders for suggestions to improve notices and post those suggestions on a public Department website.
