If a person dies while a benefit claim or an appeal is still pending, someone who would be eligible to get the dead person's unpaid benefits can ask to become the claimant so the claim can be finished. The request must be filed within one year after the death and must include proof of the right to substitute within the time the Secretary sets. Who is eligible is decided under section 5121, and substitution follows the Secretary’s rules.
