Title 38 › Part PART IV— - GENERAL ADMINISTRATIVE PROVISIONS › Chapter CHAPTER 53— - SPECIAL PROVISIONS RELATING TO BENEFITS › § 5306
Anyone entitled to pension, compensation, or dependency and indemnity compensation under laws the Secretary runs may give up those benefits by filing a signed written renouncement. Once filed, payments stop and the right ends from that date. You can apply again later, but the new claim pays only from its filing date, unless you reapply within one year for a chapter 15 pension or for parents’ DIC under section 1315 — then benefits are paid as if you never renounced.
