Title 38 › Part PART IV— - GENERAL ADMINISTRATIVE PROVISIONS › Chapter CHAPTER 53— - SPECIAL PROVISIONS RELATING TO BENEFITS › § 5318
The Secretary of Veterans Affairs must regularly compare VA records for people getting compensation or pension with Social Security death records. The check is to find beneficiaries who have died, stop payments to them quickly, and begin collecting any benefits that were paid after death. The death data comes from the Social Security Commissioner and can include state reports under a written agreement with the Secretary. That agreement must include protections to prevent misuse or improper disclosure of the information.
