The Board normally only looks at the evidence that was in the file when the VA office first decided the claim. If no hearing was asked for in the notice of disagreement and no extra time to send evidence was requested, the Board’s record stays limited to that earlier evidence. If a hearing was requested in the notice of disagreement, the Board also considers evidence given at the hearing and anything the claimant or their representative files within 90 days after the hearing. If no hearing was asked for but the claimant asked for a chance to submit evidence, the Board also considers evidence filed with the notice of disagreement and anything filed within 90 days after the Board received that notice.
