Make sure every VA medical center keeps up-to-date, checked files for each health care worker. The center must record and verify a worker’s license or certification, whether they have a Drug Enforcement Administration (DEA) registration, and key items like education, training, experience, malpractice history, and clinical skill. The center must watch for changes such as suspensions, revocations, restrictions, or other problems. Covered health care workers who need to handle controlled drugs must have an active DEA registration unless a waiver is allowed. The Secretary must decide when a waiver under section 302(d) of the Controlled Substances Act is needed and make a process to request it. Each center must learn of any DEA registration change within 7 days. If a worker loses an active DEA registration, the center must either get a waiver, move the worker to a job that does not involve controlled substances, or take appropriate personnel or contract actions. Each center must also keep checking the quality and safety of care given by its workers, review concerns quickly and in writing, and follow a Secretary-made policy that sets review timing and enforces compliance. If a concern about a worker’s skill or care is proved, the center must tell state licensing boards, the DEA, the National Practitioner Data Bank, and other relevant groups. Settlement deals cannot hide a serious medical error or lapse from the worker’s file. Staff who handle credentials, quality reviews, discipline, or notifications must get required training at least once a year. Definitions: controlled substance (as in the Controlled Substances Act); covered health care professional (employee or contractor who must be authorized to handle controlled substances); DEA registration (registration with the DEA); health care professional of the Department (someone working in the positions covered by the law, including contractors).
