Covered federal contracts must use a 40-hour workweek to figure wages. Any time a worker does more than 40 hours in a week, they must be paid at least 1.5 times their regular pay for those extra hours. Working over 40 hours is allowed only as this law says. Contracts must say that contractors and subcontractors cannot make workers do more than 40 hours a week except as allowed here. If they do, the employer must pay the worker the unpaid overtime and must pay the government liquidated damages. The damages are $10 for each calendar day a worker was forced to work over 40 hours without overtime pay. The agency paying for the work may hold back money to cover those unpaid wages and damages, subject to section 3703.
