The Secretary must set up a demonstration program with private companies to try dry storage methods for spent nuclear fuel at civilian power reactor sites. Within 1 year after January 7, 1983, the Secretary must pick at least 1 and no more than 3 sites reviewed under section 10194, giving first choice to reactors that will soon run short of interim storage. The demonstrations may test casks, caissons, or silos, and the Secretary must also work with reactors to develop fuel-rod consolidation in existing water basins. Each utility that takes part must sign a cooperative agreement saying the utility will pick the storage method, provide the land and fuel, apply for and get any needed license, build and operate the facility, and pay construction and operating costs. The Secretary will share costs and give technical help, design support, and generic licensing documents, and will do generic R&D to improve at-reactor storage if allowed by other law. The Secretary’s R&D program may test up to 300 metric tons of fuel at Federal facilities owned on January 7, 1983, using fuel provided under section 10155. Federal money, facilities, and services may cover no more than 25 percent of the program costs; the rest must come from the utilities or the Interim Storage Fund (section 10156). Use of Department-owned research facilities also requires a 30-calendar-day wait after the Secretary sends a written report to the House Committee on Science, Space, and Technology and the Senate Committee on Energy and Natural Resources, unless a committee tells the Secretary in writing within that period that it has no objection.
