Even if section 1342 of title 31 would limit it, the Corporation may ask for and accept help from organizations and people (not program participants) to do its national service work. The Corporation can pay those helpers the travel expenses listed in section 12651b(d). People who help are not treated as Federal employees for pay, hours, leave, unemployment, or benefits, except: for tort claims they are treated as Federal employees under chapter 171 of title 28; for work-injury compensation they are treated as employees under subchapter I of chapter 81 of title 5 (see section 8101(1)(B)); and for certain criminal-law rules they are special Government employees under chapter 11 of part I of title 18. Helpers may not do inherently governmental functions. The Corporation’s Chief Executive Officer must write rules defining and enforcing that limit; an inherently governmental function is one that needs a government officer’s discretion or value judgment. The Corporation may accept donations of money or property (gifts, devises, bequests, or other) and must use them as closely as possible to any donor terms. Donations are treated as gifts to the United States. The Chief Executive Officer must write rules to prevent conflicts and protect the integrity of the Corporation and its programs. When donated property (other than money) is no longer needed, the Corporation must report it to the General Services Administration and dispose of it under title II of the Federal Property and Administrative Services Act of 1949. The Corporation may enter contracts and agreements with Federal and State agencies, private firms, institutions, and individuals under chapters 1–11 of title 40 and division C (except sections 3302, 3307(e), 3501(b), 3509, 3906, 4710, and 4711) of subtitle I of title 41. The appropriate Office of Management and Budget circulars also apply.
