A homeownership program must let eligible families buy an ownership interest or shares in units. The program can use different forms of ownership, like co-ops or fee simple (including condominiums), if the Secretary says they are appropriate. The sale price and all monthly costs (principal, insurance, taxes, interest, and closing costs) must be set so the family does not pay more than 30 percent of its adjusted monthly income to complete a sale. The program must have a written plan for picking eligible families, offering help to move if families choose, keeping homes affordable, and giving training and counseling to buyers and owners. Buying or fixing up property under the program must usually cover all units in the building unless the Secretary agrees a partial sale won’t hurt other tenants. The application must explain how rehabilitation and purchases will be financed, including possible grants, cash sales, conventional mortgages, or mortgages insured under title II of the National Housing Act. Property transferred may not be used as loan collateral unless the Secretary finds it won’t threaten long-term low-income use, won’t expose the government to undue risk, the debt can be paid from project income, and the funds are used only for housing standards or allowed capital improvements. Lenders must give a reasonable chance to fix a default before foreclosing. Units must be safe before transfer and meet the Secretary’s minimum housing standards within 2 years. No tenant living in a unit when a grant is approved may be evicted because of the program. If a tenant does not buy or cannot qualify, the Secretary must, if money is available, make rental help under section 1437f available. Tenants must also be told about relocation help if they choose to move.
