Title 42 › Chapter CHAPTER 9— - HOUSING OF PERSONS ENGAGED IN NATIONAL DEFENSE › Subchapter SUBCHAPTER IX— - DEFENSE HOUSING AND COMMUNITY FACILITIES AND SERVICES › § 1592a
Permanent housing built under this authority must be one- to four-family homes (including row houses) that can be sold separately. These homes must be sold as quickly as is wise, while keeping in mind the continuing need for defense workers. People living in a home and veterans get priority to buy over other buyers. Among veterans, those found by the Secretary of Veterans Affairs to have service-connected disabilities get the highest priority. Buildings with more than four families must be sold as a single project. For such projects, HUD may give veteran cooperatives a first chance to buy for at least 90 days and at most 6 months after HUD announces availability. HUD must use a fair way to choose among competing preferred buyers. Sales may be for cash or credit, at fair value set by HUD, with full payment due within no more than 25 years and interest at not less than 4% per year. When only short-term housing is needed, HUD may provide temporary, mobile, reusable, or existing housing. If HUD later decides those temporary units are no longer needed, they must be transferred to Defense, reported to the General Services Administration, or sold quickly after public notice to the highest responsible bidder. If a veteran bids to buy a unit to live in, the unit must go to the highest responsible veteran bidder. HUD may reject bids under two-thirds of appraised value. Units can be sold to a government agency at fair value. Structures are usually sold for removal from the site unless the local government approves keeping them on site. When HUD decides housing is no longer required for defense workers, veterans get priority to live there until it is sold or disposed, and disabled veterans with VA service-connected disabilities get top priority.
