If enough money is given by Congress, the Administrator must use 30 percent of the funds made available for a fiscal year under this part to help State-run grant, rebate, and low‑cost loan programs that cut diesel pollution. The Administrator must give States clear guidance on how to apply, what the money can pay for, and which pollution-control options are cost‑effective. The Administrator will set an annual application deadline, a way to approve or deny applications, and a simpler way for States to renew approved applications. For each year, the Administrator will divide funds among States whose applications are approved. Using not more than 20 percent of the funds made available to carry out this part for a fiscal year, the Administrator will give each qualified State an amount equal to 1/53 of those funds. Guam, the U.S. Virgin Islands, American Samoa, and the Northern Mariana Islands together get 1/53 divided equally among them, unless one does not qualify, in which case its share is reallocated based on population. If a State agrees to match its allocation, the Administrator will add 50 percent more to that State’s allocation. States may not use these federal funds to meet the matching requirement. Any funds not claimed by States will be used to carry out section 16132. A State must use its money, as practical and in line with the priorities in section 16132, to create and run grants, rebates, and low‑cost revolving loans that meet State needs for cutting diesel emissions. The State’s chief executive decides how much goes to grants, rebates, or loans. Any project paid for must involve a certified engine configuration or a verified technology. Within 60 days after awarding a grant, rebate, or loan, the State must post on its website either the total number and dollar amount and technologies funded for vehicle or fleet awards, or a description of each funded application for other awards.
