Each year, the Secretary must split the grant money like this: 34% to one group of local governments, 34% to another group of local governments, 28% to States, 2% to Indian tribes, and 2% held for competitive grants under section 17156. Grants to the local governments are given by a formula that uses the latest decennial census population, daytime population, and similar factors (for example, commercial or industrial square footage). State shares give each State at least 1.25% and divide the rest by a formula based on State population and other criteria the Secretary chooses. The Secretary must set a formula for tribes too. The Secretary must publish all formulas in the Federal Register at least 90 days before the fiscal year starts. The Secretary must also create a State and local advisory committee to help run and evaluate the program.
