Title 42 › Chapter CHAPTER 152— - ENERGY INDEPENDENCE AND SECURITY › Subchapter SUBCHAPTER VII— - IMPROVED MANAGEMENT OF ENERGY POLICY › Part Part B— - Prohibitions on Market Manipulation and False Information › § 17304
A supplier who breaks the rules in sections 17301 or 17302 can be fined up to $1,000,000, on top of any penalties under the Federal Trade Commission Act. The fines are collected the same way FTC civil penalties are. Each day the violation continues counts as a separate offense. When setting the fine, the court must look at how serious the violation was and whether the supplier fixed the harm quickly.
