Starts a federal summer EBT program that begins in summer 2024 and runs every summer after. States and eligible Tribal WIC organizations can join. The program gives summer EBT benefits to households with at least one eligible child so kids can buy food when school is out. In 2024 each eligible child gets $40 per month during the summer operational period (this amount can be adjusted as allowed under other program rules). For 2025 and later, the benefit equals the prior year’s unrounded amount adjusted for changes in the cost of the diet for the 12 months ending November 30 of the previous year, then rounded down to the nearest dollar. Benefits must be usable only by the household named, and only to buy food or WIC-style supplemental foods from approved vendors (SNAP-approved stores or territory nutrition programs for States, and WIC-approved vendors for Tribal WIC organizations). Benefits may come on an EBT card, other electronic methods the Secretary allows, or the State’s usual non-electronic method. States must auto-enroll children who are directly certified or otherwise identified as eligible from the prior school year, offer an application for others, let households opt out, and set up expungement rules (no longer than 4 months). The federal government will pay 50% of participating States’ and Tribal organizations’ administrative costs. The Secretary must issue rules within 1 year after December 29, 2022 and include anti-fraud tools, quality checks, and best practices from past pilots. Definitions: covered Indian Tribal organization = Tribal group in WIC; eligible child = child certified for free/reduced meals, directly certified, or found eligible by application; eligible household = household with at least one eligible child; supplemental foods = nutrient-rich foods approved to match nutrition and cultural needs.
