Use Section 1178 of the Social Security Act (42 U.S.C. 1320d–7) for any rule or requirement under this subchapter the same way it is used for rules under part C of title XI or for standards set under sections 1172 through 1174 of that Act. The privacy and security rules for identifiable health information that the Secretary created under sections 262(a) and 264 of the Health Insurance Portability and Accountability Act of 1996 stay in effect so long as they are consistent with this subchapter, and the Secretary must change federal regulations by rule when needed to make them match. Nothing in the subchapter removes any legal privilege a person has over their protected health information.
