Blocks Foundation money to colleges that have a contract with a Confucius Institute unless the Director, after consulting the National Academies, grants a waiver. Confucius Institute — a partnership between a U.S. and a Chinese university that teaches Chinese language and culture and is funded by the Chinese government. A waiver can be given only if the contract clearly protects academic freedom; bars any foreign law on campus; gives the college full control over the institute’s management, teaching, research awards, and hiring; and keeps the institute separate from the college’s own language and culture programs and materials. The rule does not apply if the college already received the Department of Defense waiver under section 1062 of the FY2021 NDAA, and it does not stop money given to students as educational aid. The funding limit begins in the first fiscal year that begins after two years from August 9, 2022, and the rule ends five years after August 9, 2022.
