Within 120 days after March 10, 1978, the Commission must make rules after talking with the Secretary of State. The rules must cover how to grant, suspend, revoke, or change nuclear export licenses or exemptions; when the public can take part in licensing cases if the Commission finds that helpful (courts may only review whether that finding was arbitrary and capricious); requiring a public written opinion with any dissenting views; and giving public notice and keeping records. Until the rules exist, the Commission must use temporary procedures. The rules made will be the only basis for hearings on nuclear export licenses, and the Commission does not have to give anyone an on-the-record hearing in those cases.
