Title 42 › Chapter CHAPTER 6A— - PUBLIC HEALTH SERVICE › Subchapter SUBCHAPTER I— - ADMINISTRATION AND MISCELLANEOUS PROVISIONS › Part Part B— - Miscellaneous Provisions › § 238m
The Secretary may hire fiscal agents to handle payment work for health care. These agents can decide how much to pay people who provide care for eligible Indians under the Indian Health Service and for providers paid under sections 247d or 249. They can receive, pay out, and keep records of funds, audit records to make sure payments are correct, and do other needed tasks. Such contracts can ignore 41 U.S.C. 6101 and other competition rules, but only if the Secretary finds the entity will work efficiently and is financially and legally responsible. Contracts may include advance payments. Subsections (d) and (e) of section 1395u apply the same way. “Fiscal agent” means the carrier in 1395u(f)(1) and also includes an Indian tribe or tribal organization under Public Law 93–638 (25 U.S.C. 5321 et seq.).
