The Secretary must create rules to decide three things: whether a person is eligible, whether an eligible person suffered a covered injury and how much medical or other payment they should get, and whether a covered injury caused a person’s death for survivor benefits. The Secretary can accept a certification from a federal, state, local, or private health entity that someone is a covered individual. If an injury is listed in the official injury table and happens within the listed time, it is presumed to be caused by the vaccine. For other cases, the Secretary will use a "preponderance of the evidence" standard, consider all medical and scientific evidence, and may get expert opinions. A person must file an initial request for benefits within one year after the vaccine was given, or within two years after the first symptom for accidental vaccinia, or the Secretary will not consider the claim. If payments are likely to be needed for more than one year, the Secretary may pay a lump sum, buy an annuity or insurance, or make a structured settlement equal to the present value of the projected benefits. The Secretary can review or change decisions at any time and must offer a way to request reconsideration. No court or government officer may review the Secretary’s actions here unless the President specifically directs otherwise.
