The Secretary may make one loan of up to $25,000 to a Corps member who signs a written agreement to work full-time in private clinical practice in a health professional shortage area for at least 2 years. If the member had a required period of service, that private practice must start within 1 year after finishing it; if not, the Secretary decides the start time. The member must follow the practice rules in section 254n(b)(1) and any other conditions the Secretary requires. Interest on the loan cannot exceed 5 percent per year. An application must be approved, and the Secretary will set repayment terms by regulation. If the Secretary finds the member broke the agreement, the member will be notified. If within 60 days after that notice the member is not practicing as promised and has not given acceptable assurances, the United States can recover money. For people who received a grant under the old rule (before October 1, 1984) the amount is figured under section 254o(b) with the law’s adjustments. For loan recipients, the government can collect the full principal and interest owed.
