Title 42 › Chapter CHAPTER 6A— - PUBLIC HEALTH SERVICE › Subchapter SUBCHAPTER XXV— - REQUIREMENTS RELATING TO HEALTH INSURANCE COVERAGE › Part Part A— - Individual and Group Market Reforms › Subpart Subpart I— - General Reform › § 300gg–9
When offering health insurance to a small employer or to an individual, an insurance company must say in its sales materials that certain plan information is available. If the employer or individual asks, the company must give that information. The information includes how the company can change premium rates and what factors can affect those changes, plus the benefits and premiums for all plans the employer or individual can get. The info must be written so an average person can understand their rights and duties. The company does not have to share trade secrets or other confidential business information protected by law.
