The Secretary must split the program money among the States. Part of the split is based on how much each State and its local groups got in 1981 under certain public‑health grant programs as they existed on September 30, 1981 (for example: rodent control, community and school fluoridation, hypertension work, and related prevention and community health grants). Another part of the money must be allotted to States based on population. If a tribe or tribal organization asks to get funds directly and the Secretary decides direct grants would better serve its members, the Secretary must set aside from that State’s share an amount that matches the tribe’s 1981 share and give it to the tribe. The tribe must submit a yearly plan that meets the Secretary’s rules to get a grant. Money may go unused if a State does not apply, refuses part of its share, or has amounts reduced or repaid. The Secretary must also study and create a fair formula for dividing funds, looking at States’ financial resources, their populations, and other appropriate factors. Indian tribe — a federally recognized tribe. Tribal organization — an organization that represents such a tribe.
