Title 42 › Chapter CHAPTER 82— - SOLID WASTE DISPOSAL › Subchapter SUBCHAPTER I— - GENERAL PROVISIONS › § 6907

Last updated Apr 6, 2026|Official source

Summary

The Administrator must create and publish suggested guidelines for managing solid waste within one year of October 21, 1976, and update them as needed. The Administrator must work with federal, State, municipal, and intermunicipal agencies, talk with other interested people, and hold public hearings. The guidelines must describe what technical and economic performance can be reached by different waste practices. Not later than two years after October 21, 1976, they must set minimum performance levels covering public health and welfare, protection of ground and surface waters (including runoff limits under the Federal Water Pollution Control Act), air quality (including Clean Air Act requirements), disease and vector control, safety, and esthetics. The guidelines must also give minimum rules States should use to define “open dumping” of solid or hazardous waste that must be banned under subchapter IV. Before publishing any suggested guidelines or proposed regulations, the Administrator must notify the Senate Committee on Environment and Public Works and the House Committee on Energy and Commerce a reasonable time in advance and tell them what the proposals contain.
