EPA and state inspectors may ask any person or business that makes, stores, treats, moves, or disposes of hazardous waste for information and records. They may visit places where hazardous waste is or was handled, inspect them at reasonable times, and take samples of the waste, containers, or labels. Most records and reports they get must be public. But if someone shows the EPA or a State that certain information is protected by federal law (title 18, section 1905), that part can be kept confidential. People can mark data they think is confidential and send it separately. Anyone not covered by that federal protection who willfully reveals protected information can be fined up to $5,000 or jailed up to one year. Congress may get any information from the EPA if a properly authorized committee asks in writing. The EPA must inspect federal facilities that treat, store, or dispose of hazardous waste at least once a year and charge the owning federal agency for the inspection costs. For the first inspection of each such facility after October 6, 1992, the EPA must do a full groundwater monitoring check unless one was done in the prior 12 months. The EPA must also inspect state or local government facilities that need permits at least once a year. The EPA (or an authorized State) must start a program to inspect every permitted facility at least every two years, beginning within 12 months after November 8, 1984, and must make rules, after public notice and comment, on how often and how inspections are done and reported. Within six months after November 8, 1984, the EPA must report to Congress on using private inspectors to help, with recommendations and input from States, insurers, and inspection companies.
