Governors must, within 180 days after the federal region guidelines are published, make state rules that show the boundaries of areas in the state that are right for regional solid waste management. They must talk with local elected officials first. Those rules can be changed later if needed. Within 180 days after those rules are made, the State and local elected officials must work together to pick an agency to write the State plan and one or more agencies to carry it out. They must also decide which waste work the State will do and which will be done by regional or local authorities or by both. If a multi-purpose regional agency appointed by the Governor existed on October 21, 1976, the Governor must use it to write the plan for that region. State agencies must be chosen by the Governor; local or regional agencies must have at least a majority of elected local officials. If no agencies are chosen, the Governor must pick or create a State agency before 270 days after the rules were made. If a region crosses state lines, the Governors must agree on its borders after consulting local officials. Within 180 days after that agreement, local officials in the region must pick an agency to write the regional plan. If they do not, the Governors can set up one representative group that includes local elected officials. Carrying out interstate plans must be done by local governments for their parts, or by multi-area agencies chosen under State law or agreements. If none are chosen, the Governors must create a single interstate agency to run the plan. The part of an interstate plan done inside a State counts as that State’s plan.
