Title 43 › Chapter CHAPTER 25— - UNLAWFUL INCLOSURES OR OCCUPANCY; OBSTRUCTING SETTLEMENT OR TRANSIT › § 1062
The United States attorney must file a civil lawsuit in the right federal or territorial court when a U.S. citizen gives a sworn statement saying section 1061 is being broken. The statement must describe the enclosed land clearly enough to find it (survey lines not required) and name or describe the people who control the enclosure if their names aren’t known. Any court where the land is located can stop the violation by injunction. Serving an agent or employee in charge is enough to start the case. If the enclosure is unlawful, the court will order it torn down unless the defendant removes it within five days after the order.
