The Secretary requires that anyone getting a loan must pay part of the building cost of the distribution and drainage system. The borrower must give up to 10% of the construction cost in money, materials, labor, land, or land interests, valued fairly. Plans must follow good engineering and meet the project’s goals. Borrowers must keep full records of how they spend the loan and must immediately return any money not used so it can be applied to paying off the loan. Groups that repay loans must run and keep the works up under reasonable rules that protect the United States. The Secretary can return lands or works the United States holds back to borrowers. If lands or works are returned, the repayment contract must be changed to add protections the Secretary thinks are needed to make sure the loan is paid on time. Heads of other federal agencies may give revocable permission to use their lands when those lands are reasonably needed for the works, except for lands managed as national parks, national monuments, or for wildlife.
