Title 43 › Chapter CHAPTER 15— - APPROPRIATION OF WATERS; RESERVOIR SITES › § 661
People who first claimed and used water for mining, farming, manufacturing, or similar uses, and whose rights are recognized by local custom, law, or courts, must be protected. The right to build the ditches and canals needed for those uses is also confirmed. If building a ditch or canal harms a settler’s possession on public land, the builder must pay for the damage. Land patents, preemptions, and homesteads remain subject to any existing water, ditch, or reservoir rights.
