Title 43 › Chapter CHAPTER 21— - GRANTS IN AID OF RAILROADS AND WAGON ROADS › § 908
The Secretary of the Interior can require railroad companies that must pay for surveys and land conveyances to put up money. Within 90 days after the Secretary asks, the railroad must deposit enough money in a U.S. government depository to pay for surveying, selecting, and conveying any unsurveyed granted lands. The Secretary will tell the company how much to deposit and can ask for money for the whole unsurveyed area or for specific townships. The Interior Department will use the funds to pay survey and conveyance costs. Any extra money left over must be returned to the company or its assigns.
