Title 43 › Chapter CHAPTER 21— - GRANTS IN AID OF RAILROADS AND WAGON ROADS › § 909
A railroad that is required to pay the costs to survey, select, or transfer lands given to it by Congress must, within 90 days after the Secretary of the Interior gives notice under section 908, put up enough money to cover those costs for the unsurveyed lands named in the notice. If the railroad (or anyone claiming through it) fails to do this, its ownership and claims to those named unsurveyed lands end and the lands go back to the United States. The Secretary of the Interior must tell the Attorney General, who must immediately start legal action to declare the forfeiture and return the lands to the public domain.
