Agencies cannot collect information from the public unless they follow a set process first. The agency must review the need for the collection, consider public comments, send the Director the required certification and supporting materials, and publish a Federal Register notice saying it has made the submission. That notice must include a title, a short summary, why the information is needed and how it will be used, who will respond and how often, an estimate of the time or burden, and a statement that comments are welcome. The Director must have at least 30 days to get public comment before deciding. The Director must approve the collection or the agency can assume approval if the Director does not act within 60 days after the notice. A control number from the Director must be displayed on the collection. If approval is inferred, the agency may collect the information for not more than 1 year. Special rules apply for collections inside proposed rules. Agencies must send the proposed rule to the Director when they publish it. The Director has 60 days to comment. When the final rule is published, the agency must explain how it answered those comments or why it rejected them. The Director may still disapprove in certain cases, such as if the agency failed to give required information or substantially changed the collection without proper notice. An independent agency can override a Director disapproval by majority vote; that override lasts 3 years. The Director cannot approve a collection for more than 3 years. To renew approval, agencies must seek comment and submit the request at least 60 days before the control number expires and explain how they used the information. The Director may delegate approval authority to a qualified senior official, and may allow emergency collections for up to 180 days if the agency head shows urgent need.
