Title 45 › Chapter CHAPTER 21— - ALASKA RAILROAD TRANSFER › § 1208
After January 14, 1983, the Alaska Railroad or any state-owned railroad can ask the Secretary of the Interior or the Secretary of Agriculture to quickly approve a right-of-way across federal land for transportation and related uses. They can also apply for leases, permits, or transfers for nearby terminals, stations, and material sites. Before approval, the Interior or Agriculture Secretary must consult with the Secretary and follow applicable law. When possible, the grants should meet the standards from the Act of March 12, 1914 and section 1202(6); that requirement is not changed by the repeal of the 1914 Act under section 615.
