Title 45 › Chapter CHAPTER 2— - LIABILITY FOR INJURIES TO EMPLOYEES › § 51
Makes railroad companies responsible for paying damages when a worker is hurt while working in trade between states, territories, the District of Columbia, or with other countries. If the worker dies, money goes to the worker’s personal representative to benefit the surviving spouse and children; if there are none, then to the parents; if none, then to the next of kin who depended on the worker. The law covers injuries caused in whole or in part by careless railroad officers, agents, or employees, or by defects in the railroad’s equipment or structures (cars, engines, tracks, bridges, boats, wharves, or other gear). Employee: any worker whose job furthers or directly, closely, and substantially affects interstate or foreign commerce.
