Title 45 › Chapter CHAPTER 18— - MILWAUKEE RAILROAD RESTRUCTURING › § 903
Milwaukee Railroad can negotiate and make deals to sell all or part of the tracks and other rail property it used on October 15, 1979. It may sell to another railroad or to anyone. No sale can become final until the event described in section 920(b) happens or until April 1, 1980, whichever comes first. The railroad may talk with the Secretary of Transportation while doing this. The Secretary of Transportation, under section 333 of title 49, can make plans, join negotiations, and recommend sale or transfer proposals to the railroad’s trustee. The Secretary must favor financially responsible buyers, including government entities that plan to keep public rail service. Any proposal the Secretary makes must go to the bankruptcy court and also cannot become final until the event in section 920(b) or April 1, 1980, whichever comes first.
