People who break these rules must pay a civil penalty after they get notice and a chance for a hearing. The Secretary will send a written notice of the penalty and will decide the amount by looking at how serious the violation was, how it happened, the person’s blame and prior offenses, ability to pay, and other fair factors. Until the case is sent to the Attorney General, the Secretary may settle, change, or cancel a penalty. If a final penalty is not paid, the Secretary may refer it to the Attorney General to collect in a U.S. district court.
