Owners, charterers, managing operators, or agents of U.S. vessels must immediately tell the Coast Guard and do everything they can to find out what happened if they have reason to think a vessel is lost or in danger (for example, no communication or the vessel does not appear). The same duty applies if more than 48 hours pass since the last contact for vessels that must report to the U.S. Flag Merchant Vessel Location Filing System. When notifying the Coast Guard they must give the vessel name and ID, the names of people on board, and any other information asked for, and they must send written confirmation within 24 hours after a nonwritten notice. The ship’s master must report to the owner, charterer, managing operator, or agent at least once every 48 hours. Violations can bring fines up to $5,000 per day for owners/agents and up to $1,000 per day for masters. The Secretary can make rules to carry out these requirements.
