Every passenger vessel except ferries must have a certificate that shows how many passengers it may carry. If a vessel carries more people than that number, the owner or person in charge (for example, the charterer, operator, agent, or master) must pay back the fare and $100 for each extra passenger to anyone who sues. If they knowingly carry too many people, they can be fined up to $100, jailed up to 30 days, or both. The vessel itself can also be held responsible for the penalty. Offshore supply vessels may only carry passengers in an emergency.
