People who willfully break the safety rules for recreational boats can face criminal punishment. A person who knowingly operates a boat against these rules can be fined up to $5,000, jailed for up to one year, or both. Breaking the rule in section 4307(a) can lead to a civil fine up to $5,000, or up to $250,000 for a related series of violations. If the Secretary finds a safety defect and orders the maker to notify owners, anyone who knowingly ignores that order can be fined up to $10,000, jailed up to one year, or both. If a company breaks the rule or ignores the Secretary’s order, a director, officer, or executive who knowingly ordered or allowed the break can be fined too, unless they can prove it is more likely than not that they reasonably believed the defect did not pose a substantial risk and that they told the Secretary in writing at the time. Other penalties: breaking section 4312(b) leads to $100 for the first offense, $250 for the second, and $500 for later offenses. Most other violations can bring civil fines up to $1,000, and the boat itself can be held responsible if the violation involves operation. Fines of $200 or less can be sent to a magistrate judge for collection. Federal courts can stop violations or stop sale or import of nonconforming boats after the Attorney General files a petition; the Secretary should normally give notice and a chance to fix the problem unless the violation was knowing and willful. A person is not liable if they can show they had no reason to know of the defect when acting with reasonable care, or if they relied on a manufacturer’s certificate of conformity unless they knew or should have known it was false. Following these federal rules does not remove liability under state law or common law.
