Summary

Pays a contractor for each covered vessel a set yearly amount, if money is available. The payment amounts are: $5,000,000 for fiscal years 2018–2020; $8,233,463 for FY2021; $5,300,000 for FY2022–2024; $6,500,000 for FY2025–2026; $6,675,500 for FY2027–2028; $6,855,000 for FY2029–2030; $7,040,000 for FY2031–2032; $7,230,000 for FY2033–2034; $7,426,000 for FY2035–2036; $7,626,000 for FY2037–2038; and $7,832,000 for FY2039–2040. Payments are made in equal monthly amounts at the end of each month and are not cut unless the rules in this part or section 51307(b) require it. To get payment for a year, the contractor must certify the vessel was and will be operated under the required operating rules for at least 320 days in that fiscal year. Time while the vessel is drydocked, surveyed, inspected, or repaired counts as days of operation. No payment is made for days when the vessel is under a U.S. Government charter (except an Emergency Preparedness Agreement under section 53107), not run or maintained under its operating agreement, or is older than 25 years (20 years for a tank vessel), subject to any stated exceptions. Payments generally are not reduced for carrying military or other preference cargoes, but no payment is made for any day the vessel carries more than 7,500 tons of civilian bulk preference cargo that is bulk. Payments are cut proportionally for each year day under 320 that the vessel is not operated as required. A contractor cannot get payments while it "participates in noncontiguous domestic trade" unless it meets the 75% U.S. ownership citizen rule. "Participates in noncontiguous domestic trade" means owning, chartering, or operating a ship that moves cargo between the contiguous 48 States and Alaska, Hawaii, or Puerto Rico (except points in Alaska north of the Arctic Circle).
