Vessels must carry and use an automatic identification system (AIS) while on U.S. navigable waters if they are a self-propelled commercial vessel 65 feet or longer, a vessel carrying more passengers for hire than the Secretary sets, a towing vessel over 26 feet long with more than 600 horsepower, or any other vessel the Secretary finds needs AIS for safe navigation. The Secretary can exempt a specific vessel or waive the rule for certain waters if AIS is not needed for safe navigation there. The Secretary must write rules to put these requirements into effect, including how the AIS must be operated and maintained.
