Title 46 › Subtitle Subtitle II— - Vessels and Seamen › Part Part F— - Manning of Vessels › Chapter CHAPTER 85— - PILOTS › § 8501
States set the rules for pilots who guide ships in U.S. bays, rivers, harbors, and ports unless another rule in this subtitle says otherwise. If a ship is entering or leaving a port on waters that border two States and a pilot is required, the ship’s master can hire a pilot licensed by either State. A State cannot charge different pilotage rates for ships going only between its ports versus between different States, nor treat ships differently because of how they are powered or because they are U.S. public vessels. A State also cannot force a coastwise vessel to use a State-licensed pilot if the vessel is (1) powered by machinery and inspected under part B of this subtitle, or (2) inspected under chapter 37 of this title. Any rule that breaks these limits is void.
