The Federal Communications Commission (FCC) must, within 180 days after October 5, 1992, start rulemaking to set public-interest rules for direct broadcast satellite (DBS) companies that carry video. The FCC must at least apply rules like access to broadcast time and use-of-facilities rights to those satellite video services. The rulemaking must also look at how satellite service can serve local communities and how technology or rules can help local programming. The FCC must require satellite TV providers to set aside part of their channel space for noncommercial educational or informational programs. For most providers that share video, the reserve must be at least 4% and no more than 7% of capacity. For a “qualified” provider the reserve can be 3.5% to 7%. Unused reserved capacity can be used for other things until it is actually filled with educational shows. Providers must offer that space to national educational program suppliers at reasonable prices and cannot control the programs’ content. The FCC will decide what “reasonable” means but must consider nonprofit status and federal support, cap prices at 50% of direct costs, and exclude marketing, general overhead, and the revenue the provider would have earned from a commercial buyer. A few key terms: provider of DBS = Ku-band satellite licensees or distributors that send video to homes; national educational programming supplier = public TV stations, public telecom groups, or schools; qualified satellite provider = one that carries State public affairs networks from at least 15 States and meets other conditions; State public affairs network = noncommercial outlets that cover State government and are run by a State, a 501(c)(3) with an independent board, or a cable system.
